| Description: | Once the Political Constitution of 1991 was enacted, Colombia has given special protection to the environment, creating a series of mechanisms that can guarantee its integrity. However, despite the existence of regulations and public policies on this matter, it is evident the prioritization of a substantial content and weaknesses in its application, as in the case of the Suesca Lagoon, which has been presenting a progressive depletion in its water body, reaching a critical point in the year 2020, when it reduced its volume in a high percentage. From there arises the objective of the research, being to analyze the public policies aimed at the protection of the Suesca lagoon and its application in the municipality of Suesca Cundinamarca. To approach, this research a qualitative approach was used, and the legal-systematic research method was employed, which allows a comprehensive understanding of the phenomena under study in an integral way, together with the application of semi-structured interviews, whose analysis, focused on the measures adopted from the perspective of public policies aimed at the protection of the Suesca lagoon. These strategies showed that on the one hand, prevention has not been prioritized in terms of this water resource, giving way to mostly mitigation measures. On the other hand, the participation spaces that include the affected or interested population in the construction of such public policies are still incipient and demand greater attention and prioritization. Una vez promulgada la Constitución Política de 1991, Colombia ha dado una especial protección al medio ambiente, creando una serie mecanismos que puedan garantizar su integridad. Sin embargo, a pesar de la existencia de normativa y políticas públicas en dicha materia, se evidencia la priorización de un contenido sustancial y debilidades en su aplicación, como ocurre en el caso de la laguna de Suesca, que ha venido presentando un agotamiento progresivo en su cuerpo hídrico, llegando a un punto crítico en el año 2020, cuando redujo su volumen en un alto porcentaje. Desde allí surge el objetivo de la investigación, que es analizar las políticas públicas encaminadas a la protección de la laguna de Suesca y su aplicación en el municipio de Suesca, Cundinamarca. Para abordar esta investigación, se utilizó un enfoque cualitativo y se empleó el método de investigación jurídico-sistemático, el cual permite comprender de manera integral los fenómenos objeto de estudio. Además, se realizaron entrevistas semiestructuradas, cuyo análisis se centró en las medidas adoptadas desde la perspectiva de las políticas públicas encaminadas a la protección de la laguna de Suesca. Tales estrategias permitieron evidenciar que, por un lado, no se ha priorizado la prevención en materia de este recurso hídrico y se han implementado, principalmente, medidas de mitigación. Por otro lado, se observó que los espacios de participación que incluyen a la población afectada o interesada en la construcción de dichas políticas públicas aún son incipientes y demandan mayor atención y priorización. |
