Con la reforma Constitucional de junio del 2011, se implementó la regulación de los derechos humanos como derechos fundamentales de los gobernados, estableciéndose como obligaciones del Estado, la protección, promoción y defensa de éstos en los diferentes niveles de gobierno. Este artículo, establece la importancia que reviste el exacto cumplimiento del ejercicio jurisdiccional en materia de derechos humanos para obtener una sanción judicial, con motivo de su violación entre particulares, encontrándose dentro de ellos, las personas físicas y las empresas, cuyo origen es la separación y autonomía del derecho sustantivo vigente de los derechos mencionados, para lograr obtener esa seguridad y certeza jurídica, en bien de los súbditos del Estado, con el debido ejercicio de las garantías constitucionales. With the Constitutional reform of June 2011, the regulation of human rights was implemented as fundamental rights of the governed, establishing as obligations of the State, the protection, promotion and defense of these at the different levels of government. This article establishes the importance of the exact fulfillment of the jurisdictional exercise in the matter of human rights to obtain a judicial sanction, due to its violation between individuals, being within them, the natural persons and the companies, whose origin is the separation and autonomy of the current substantive law of the aforementioned rights, in order to obtain that security and legal certainty, for the good of the subjects of the State, with the due exercise of constitutional guarantees.
